    What is Spousal Sponsorship?

Spousal Sponsorship is a Canadian immigration program that allows a Canadian citizen or permanent resident to sponsor their spouse, common-law partner, or conjugal partner for permanent residency in Canada. This program ensures that families can stay together and enjoy the benefits of living in one of the world’s most desirable countries.

What are the Requirements for Spousal Sponsorship?

Spousal sponsorship involves specific requirements for both the sponsor and the person being sponsored. Here’s a brief outline of the key requirements:

    1. Sponsor's Eligibility:

    a. Citizenship/Residency: The sponsor must be a Canadian citizen or permanent resident. b. Age: The sponsor must be at least 18 years old. c. Financial Capability: The sponsor must demonstrate the ability to financially support the sponsored person, without relying on social assistance.

    2. Relationship Requirements:

    a. Legally Recognized Relationship: The sponsored person must be the spouse, common-law partner, or conjugal partner of the sponsor. b. Genuine Relationship: The relationship must be genuine, and not entered primarily for immigration purposes. c. Age: Both the sponsor and the sponsored person must be at least 18 years old.

    3. Inadmissibility Factors:

    a. The sponsored person must not be inadmissible to Canada due to criminality, medical issues, misrepresentation, or other factors as outlined by Canadian immigration law.

    4. Application Requirements:

    a. Complete and accurate application forms for both the sponsor and the sponsored person. b. Required documents, such as proof of relationship (marriage certificate, joint bank accounts, photos together), identity documents (passports, birth certificates), financial documents, and police certificates. c. Payment of required application fees, including processing fees and right of permanent residence fees.

    5. Additional Requirements (if applicable):

    a. Biometrics: The sponsored person may need to provide biometrics, depending on their country of origin. b. Medical Examination: The sponsored person must undergo a medical examination by a panel physician.

By understanding and fulfilling the requirements for spousal sponsorship, you can improve the chances of a successful application and help your partner join you in Canada.

What is the process to apply for Spousal Sponsorship?

Applying for spousal sponsorship involves a series of requirements and steps to ensure a successful application. Here’s a brief outline of the process and requirements:

    1. Determine Eligibility: The sponsor must be a Canadian citizen or permanent resident, at least 18 years old, and financially capable of supporting the sponsored person. The sponsored person must also be at least 18 years old and be the spouse, common-law partner, or conjugal partner of the sponsor.
    2. Choose Application Type: Decide whether to apply for Inland (the sponsored person living in Canada) or Outland (sponsored person living outside Canada) spousal sponsorship.
    3. Gather Required Documents: Collect all necessary documents, such as proof of relationship (marriage certificate, joint bank accounts, photos together), identity documents (passports, birth certificates), financial documents, and police certificates.
    4. Complete Application Forms: Fill out the relevant application forms for both the sponsor and the sponsored person. Ensure that all information is accurate and complete.
    5. Pay Application Fees: Pay the required fees for processing, the right of permanent residence, and biometrics (if applicable).
    6. Submit Application: Submit the application package to the appropriate processing center (in Canada for Inland or the visa office responsible for the sponsored person’s country of residence for Outland).
    7. Biometrics and Medical Exam: If required, the sponsored person must provide biometrics and undergo a medical examination by a panel physician.
    8. Interview and Additional Information: If needed, the sponsored person or the sponsor may be asked to attend an interview or provide additional information to support the application.
    9. Application Decision: Immigration, Refugees, and Citizenship Canada (IRCC) will assess the application and provide a decision. If approved, the sponsored person will receive permanent resident status.
    10. Post-Approval Steps: Once granted permanent residency, the sponsored person should apply for a permanent resident card and, eventually, may consider applying for Canadian citizenship.

    Inland vs. Outland Spousal Sponsorship

There are two types of spousal sponsorship applications: Inland and Outland.

    Inland Spousal Sponsorship:

This application is for spouses or common-law partners who are already living in Canada with their sponsor. The sponsored person can apply for an open work permit during the application process.

    Outland Spousal Sponsorship:

This application is for spouses or common-law partners living outside Canada. The application is processed through the visa office responsible for the applicant’s country of residence.
