A Spousal Open Work Permit (SOWP) is a unique type of work permit designed for spouses or common-law partners of temporary residents in Canada. This work permit allows them to work without being tied to a specific employer or job position. At ISB Immigration Services, we understand the importance of keeping families together and are here to guide you through the process of applying for a Spousal Open Work Permit for your spouse or partner.

What is a Spousal Open Work Permit?

A Spousal Open Work Permit is a document that allows the spouse or common-law partner of a temporary resident in Canada to work freely without being tied to a specific employer. This type of work permit provides flexibility for spouses or partners, allowing them to find employment in any occupation or industry, as long as it is not restricted by the government.

What are the Eligibility Criteria for a Spousal Open Work Permit?

To be eligible for a Spousal Open Work Permit, the applicant must meet the following criteria:

    1: Relationship Status

The applicant must be in a genuine relationship with a temporary resident in Canada, either as a spouse (legally married) or a common-law partner (cohabiting in a conjugal relationship for at least one year).

    2: Primary Applicant's Status

The primary applicant (spouse or partner in Canada) must hold a valid study or work permit. They should be a full-time student at a designated learning institution or a skilled worker in an eligible occupation under the National Occupational Classification (NOC) system.

3: Duration of Primary Applicant's Permit

The primary applicant’s study or work permit must be valid for at least six months at the time of the SOWP application, ensuring that the spouse has enough time to benefit from the open work permit.

    4: Compliance with Permit Conditions

Both the applicant and the primary applicant must have complied with the conditions of their respective permits, such as not working without authorization or overstaying a previous permit. This helps demonstrate good faith and compliance with Canadian immigration regulations.

    5: Admissibility to Canada

The applicant for the Spousal Open Work Permit must be admissible to Canada, meaning they must pass necessary security and medical checks and not have a criminal record or pose a threat to public safety.

Spousal Open Work Permit Under Different Programs

There are several programs under which you can apply for a Spousal Open Work Permit:

    1. International Experience Canada (IEC) – Working Holiday, Young Professionals, and International Co-op The IEC program is divided into three categories: Working Holiday, Young Professionals, and International Co-op. Eligible candidates from participating countries can work in Canada temporarily under one of these categories. If the primary applicant is participating in any of these IEC categories, their spouse or common-law partner may apply for a Spousal Open Work Permit, which allows them to work for any employer in Canada.
    2. Post-Graduation Work Permit (PGWP) Program – Working After Graduation The PGWP program enables international students who have completed their studies at a designated learning institution (DLI) in Canada to gain valuable Canadian work experience. A PGWP holder can work for any employer in Canada for a specified duration based on the length of their study program. If the primary applicant holds a valid PGWP, their spouse or common-law partner may apply for a Spousal Open Work Permit, allowing them to work in Canada as well.
    3. Inland Sponsorship – Spousal Sponsorship Inland Spousal Sponsorship allows a Canadian citizen or permanent resident to sponsor their spouse or common-law partner for permanent residency while living together in Canada. During the processing of the permanent residency application, the spouse or common-law partner may be eligible for an Inland Spousal Open Work Permit, which lets them work for any employer in Canada until a decision is made on their application.
    4. Provincial Nominee Programs (PNPs) – Provincial Nominations for Permanent Residency PNPs enable Canadian provinces and territories to nominate immigrants based on their specific economic needs. If the primary applicant has been nominated for permanent residency under a PNP and has a valid job offer in the nominating province or territory, their spouse or common-law partner may be eligible for a Spousal Open Work Permit. This permit allows them to work for any employer in the province or territory while their partner’s permanent residency application is being processed.
